Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Orbit Apps LTD ("Explorer Rank", "we", "us", or "our") governing your use of the Explorer Rank mobile app and website (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who can use the Service
You must be at least 16 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or guardian. By using the Service you confirm you meet these requirements.
2. Your account
You are responsible for the activity on your account and for keeping your login credentials secure. You agree to provide accurate information and to keep it up to date. You may sign in through third-party providers (such as Google); your use of those providers is subject to their terms. For security, Explorer Rank may limit your account to one active device at a time.
3. The Service
Explorer Rank is a travel tracking game. You verify the countries, cities, and landmarks you visit using your device's location, earn a score, unlock achievements and souvenirs, and compare your progress with friends and a global leaderboard. We may add, change, or remove features at any time. Paid entitlements (the Explorer Pass and souvenirs) are governed by Section 6.
During the launch period the leaderboard may include seeded explorer profiles that are not operated by real users. They exist so that early explorers have positions to compete for, cannot be added as friends, and are removed as the community grows.
4. Fair play
The integrity of the game depends on honest location verification. You agree not to:
- falsify, spoof, or simulate your location (for example with mock-location tools);
- use bots, scripts, or automated means to record visits or manipulate your score; or
- otherwise cheat or interfere with the scoring, leaderboards, or anti-cheat systems.
We use automated checks (including impossible-travel and mock-location detection) to protect fair play. If we detect cheating, we may reverse visits and score, remove you from leaderboards, or suspend or terminate your account. If you believe a visit or score was reversed by mistake, contact us through Contact us in the app (Profile → Support) and we will review it.
5. Your content
You retain ownership of the content you add to the Service ("Your Content"): your display name, your profile photo, and the photos you keep in Memories. Memories stay on your device and are never uploaded to us; they leave your device only when you choose to share or export them. For the parts of Your Content that we host (your display name and profile photo), you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display them for the purpose of operating the Service, including showing them to other users according to your privacy settings. You are responsible for Your Content and confirm you have the rights to share it.
Your Content and your behaviour towards other explorers must follow our Community Guidelines, which describe what is not allowed — for example sexual content, hate or harassment, impersonation, other people's personal information, spam, content that infringes someone's rights, and anything that cheats the verification or scoring system. You accept these Terms and the Community Guidelines when you create your account, before you can add any content.
You can report a profile (name or photo) or block another explorer from inside the app. Blocking removes the friendship, hides them from your leaderboard and search, and stops friend requests between you. We review every report and may remove or restrict content, suspend or terminate accounts, and keep reported content while we investigate.
6. Purchases
The Service offers one-time purchases: the Explorer Pass (unlocks premium features) and souvenirs (3D collectibles). There are no subscriptions at the moment; if we ever introduce one, these Terms will say so and describe how it renews and how you cancel.
- Purchases are processed by the Apple App Store or Google Play and are subject to their terms. The price you pay is the price shown in the store at checkout.
- Launch pricing. The Explorer Pass is sold in numbered price tiers: the price you see depends on how many passes have been sold before yours, and rises once a tier sells out. Tiers may also end on a date we announce in the app. The price shown next to a higher tier is the price of that future tier, not a former price. If a tier sells out while you are completing a purchase, your pass is still activated at the price you paid.
- "Lifetime" and "one-time" mean that you pay once and keep the entitlement for as long as Explorer Rank operates the Service (see Section 12). They are not a promise that the Service will exist forever.
- Immediate delivery. Purchases are delivered immediately. Where consumer law gives you a right to withdraw from a contract for digital content within 14 days, you agree that delivery starts at once and acknowledge that this right is lost once delivery has started.
- Except where required by law, purchases are non-refundable; refund requests are handled by the applicable app store. Gifts of souvenirs cannot be exchanged or transferred once claimed; any refund follows the app store's rules and is made to the original purchaser.
7. Travel booking and visa partners
The Service includes links to third-party travel services, including flight booking and visa partners, and we may earn a commission when you use them ("affiliate links"). Any booking, payment, or service you obtain from a partner is a contract between you and that partner. We are not a travel agent, do not provide those services, and are not responsible for them. Visa, entry, and travel information in the Service is provided for general guidance only and may be incomplete or out of date — always confirm requirements with official sources before you travel.
8. Acceptable use
You agree not to misuse the Service, including by attempting to access it in unauthorized ways, disrupting it, reverse-engineering it except as permitted by law, harassing other users, or using it for any unlawful purpose.
9. Intellectual property
The Service, including its software, design, text, graphics, and logos (excluding Your Content), is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, personal, non-transferable, revocable license to use the Service for its intended purpose. All rights not expressly granted are reserved.
10. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or accurate, including the accuracy of location verification, facts, essentials, or visa information.
11. Limitation of liability
To the fullest extent permitted by law, Explorer Rank and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or EUR 50. Nothing in these Terms limits liability that cannot be limited by law.
12. Termination
You may stop using the Service and delete your account at any time, in the app or at explorerrank.com/delete-account. We may suspend or terminate your access if you breach these Terms or to protect the Service or its users. We may also discontinue the Service; paid entitlements (Section 6) end with it, and where the law requires it we will give reasonable notice. Sections that by their nature should survive termination (such as content license, disclaimers, and limitation of liability) will survive.
13. Governing law
These Terms are governed by the laws of Bulgaria, without regard to conflict-of-laws rules. The courts of Bulgaria will have exclusive jurisdiction, except where mandatory consumer-protection law in your country of residence gives you additional rights.
14. Changes to these Terms
We may update these Terms from time to time. When we make material changes we will update the effective date above and, where appropriate, notify you in the app. Your continued use of the Service after an update means you accept the revised Terms.
15. Reporting illegal content and copyright complaints
Anyone — whether or not they use Explorer Rank — can tell us about content in the Service that they believe is illegal or infringes their rights, including copyright. This covers content added by explorers (display names and profile photos) and content we publish ourselves, such as landmark photos and descriptions.
Point of contact. Our single point of contact for users, rights holders, and authorities is hello@explorerrank.com. You can write to us in English or Bulgarian. To report an explorer's name or photo, you can also use Report on their profile in the app.
What to include. To help us act quickly, please send:
- your name and email address (you may stay anonymous only when reporting child sexual abuse material);
- a clear explanation of why you believe the content is illegal or infringes your rights — for a copyright complaint, identify the work you own or are authorised to act for;
- exactly where the content appears — for example the explorer's display name, or the landmark or country and the photo, ideally with a screenshot; and
- a statement that you believe in good faith that the information in your notice is accurate and complete.
Copyright complaints under the US Digital Millennium Copyright Act (DMCA) must also include your physical or electronic signature and a statement, under penalty of perjury, that you are the copyright owner or authorised to act on the owner's behalf.
What happens next. We confirm that we have received your notice, review it diligently and objectively, and may remove the content, disable access to it, or restrict the account that published it. We tell you what we decided and how you can challenge the decision. When we remove or restrict an explorer's content following a notice, we tell that explorer what we did and why, unless the law prevents us or the content is spam.
If your content was removed. If you believe your content was removed or restricted by mistake, reply to our message or contact us and we will review the decision again. A DMCA counter-notice must identify the removed material, state under penalty of perjury that you believe in good faith it was removed by mistake, give your name, address, and signature, and consent to the jurisdiction of the courts for your address. You can also take the matter to a court or complain to the Digital Services Coordinator in your country.
Repeat infringers and misuse. We terminate, in appropriate circumstances, the accounts of explorers who repeatedly infringe other people's rights. We may stop processing notices from anyone who repeatedly sends notices that are clearly unfounded.
